Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of registration. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or e-mail). To meet the withdrawal deadline, it is sufficient to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired. To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
- Effects of Withdrawal -
If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.
If the upgrade to a paid plan is withdrawn, the user's account will revert to the eclipso Freemail plan. Features and components of the plan upgrade can no longer be used from the day the withdrawal is confirmed.
Notice Regarding the Right of Withdrawal
The right of withdrawal expires prematurely if the contract has been fully performed by both parties at the express request of the consumer before the consumer has exercised his right of withdrawal.
Withdrawal for Digital Content
Information on the right of withdrawal for consumers regarding the supply of digital content which is not supplied on a tangible medium (e.g. account upgrades, account top-ups by deposit, apps, e-books, software downloads, online courses, file downloads, etc.)
Exclusion or Premature Expiry of the Right of Withdrawal
The right of withdrawal does not apply to contracts for the supply of digital content which is not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer. The right of withdrawal expires prematurely if we have only begun performance of the contract after you have given your express consent and at the same time confirmed your acknowledgement that you lose your right of withdrawal once we begin to perform the contract. We point out that we may make the conclusion of the contract dependent on the aforementioned consent and confirmation.
